Riding a bicycle in and around traffic present some challenges and occasionally results in a driver striking the bicyclist. Because of the potential seriousness of injuries received from bicycle / car accidents, we suggest the following safety tips:

  • Always wear a properly fitting helmet
  • Wear light colored or reflective clothing
  • Use hand signals
  • Ride defensively – make eye contact
  • Assume the driving won’t stop for you.

Many accidents and injuries can be avoided, some cannot. Over the years we have seen many situations where someone has not worn a helmet and has sustained a serious brain injury. We have also seen many situations when a helmet has been worn and has most likely saved someone from a brain injury. In fact, one of our partners, Ken Jaray, was involved in a bicycle accident and was very fortunate that his helmet took the major blow to his head when he landed on the pavement. Fortunately he was ok and he attributes that to the fact that he was wearing a helmet.

In the event of a bicycle / car accident, there is the potential to obtain compensation for injuries, damages and losses caused by the driver of the car, if they were responsible for causing he impact. Our firm has successfully represented many bicyclists over the years. The usual process involves:

  • A thorough investigation of what happened and a determination of who was at fault
  • Documentation of the nature and extent of the injuries, damages and losses
  • Presentation of a settlement proposal to the insurance company
  • If not settled informally, engage in litigation and a trial

We would be glad to talk with you about the specific facts of your accident or how we might be able to help you with this process. There is no cost to do so and we will always point you in the right direction, even if we are not able to handle your claim.
